Privacy Policy
A LEGAL DISCLAIMER
The explanations and information provided on this page are only general and high-level explanations and information on how to write your own document of a Privacy Policy. You should not rely on this article as legal advice or as recommendations regarding what you should actually do, because we cannot know in advance what are the specific privacy policies you wish to establish between your business and your customers and visitors. We recommend that you seek legal advice to help you understand and to assist you in the creation of your own Privacy Policy.
PRIVACY POLICY - THE BASICS
Having said that, a privacy policy is a statement that discloses some or all of the ways a website collects, uses, discloses, processes, and manages the data of its visitors and customers. It usually also includes a statement regarding the website’s commitment to protecting its visitors’ or customers’ privacy, and an explanation about the different mechanisms the website is implementing in order to protect privacy.
Different jurisdictions have different legal obligations of what must be included in a Privacy Policy. You are responsible to make sure you are following the relevant legislation to your activities and location.
WHAT TO INCLUDE IN THE PRIVACY POLICY
Generally speaking, a Privacy Policy often addresses these types of issues: the types of information the website is collecting and the manner in which it collects the data; an explanation about why is the website collecting these types of information; what are the website’s practices on sharing the information with third parties; ways in which your visitors an customers can exercise their rights according to the relevant privacy legislation; the specific practices regarding minors’ data collection; and much much more.

Terms & Conditions
Last updated: 01/01/2026
These Terms & Conditions include our purchasing terms, returns and refunds policy, and shipping and delivery policy for flat-pack kits.

On this page:
Part A — Purchase Terms
Part B — Returns, Refunds & Cancellations
Part C — Shipping & Delivery
Part A — Purchase Terms
A1. Who we are
Avant Living is operated by Avant & Co Pty Ltd, ABN 29 678 321 474. In these terms, “we” means Avant & Co Pty Ltd and “you” means the customer.

For orders, delivery enquiries, cancellations or product concerns, email info@avant-co.com.au or call 1300 361 800. Contact us for return or collection instructions before sending any goods.
A2. What these terms cover
These terms cover the purchase and delivery of all products identified as flat-pack kits on our website. They do not cover the Golf Simulator Room, which is currently offered separately from our flat-pack range. Read them together with the selected product description, the order details, Part B (Returns, Refunds & Cancellations) and Part C (Shipping & Delivery) below before ordering.

Installation, construction and other onsite services are not supplied under these kit-sale terms. A product or proposal described as “fully installed” requires its own applicable agreement. These terms do not replace any contract or protections required by building legislation.

Nothing in these terms limits rights or remedies that cannot be excluded by law, including under the Australian Consumer Law. A later order document or change cannot remove those rights.
A3. Your selected kit
Your purchase includes the components and options expressly listed for the configuration you select. Furniture, landscaping, decorative objects and site works shown in lifestyle images are not included unless the product description says they are. Images do not override the features or specifications we promise to supply.

For a custom order, the dimensions, finishes, inclusions and price must be agreed before you commit to that order. We will not substitute a materially different configuration without your agreement.

A request for a custom quote is an enquiry, rather than a purchase of the standard product shown on the website.
A4. Prices and paymen
Prices are in Australian dollars. Consumer prices include applicable GST. The product price, delivery charge and any other unavoidable charges for your selected order will be disclosed before you commit to the purchase.

The payment methods and amount due are shown at checkout before you place your order. We do not offer a deposit or instalment arrangement unless it is expressly displayed with its full payment terms. A deposit, where expressly offered, is part of the total price and is not the price of the entire kit.

Delivery charges are calculated automatically at checkout for your delivery address. The charge shown at checkout is the final delivery charge for that order; we will not add a mandatory remote-area, island or unloading surcharge after the order is accepted.
A5. Placing an order
For products available to buy online, your order is accepted automatically when checkout is successfully completed and any payment due at checkout has been successfully received. We will send an order confirmation as a record of your purchase. The confirmation records your selected configuration, product price, delivery charge and total. Any amount due and available payment method are shown before you place the order. A custom quote enquiry is not an accepted order.

You will receive a record of the selected configuration, total price, delivery arrangements and payment terms. Please contact us promptly if any details are incorrect.

We will not change an accepted order's price or scope without your agreement. If we identify an error or cannot supply what was ordered, we will contact you to agree a solution. If we cannot fulfil the order as agreed and you do not accept an alternative, we will refund payments for the unfulfilled order. This does not limit any additional remedy available by law.
A6. Changes and cancellatio
Contact us as soon as possible if you wish to change or cancel an order. The applicable process is set out in Part B below.

We will explain the price and timing effects of a requested change before you agree to it. We will not start chargeable additional work solely because you asked about an option.
A7. Delivery and access
Part C below explains service areas, delivery charges, timing and unloading arrangements. Please provide accurate delivery information and tell us about access restrictions, hazards and any equipment or permits needed for delivery before ordering.

Delivery of a kit does not include carrying components to their final position, assembly, foundations or installation unless those items are expressly included in a separate applicable agreement. Our responsibility for supplying the kit and meeting our delivery commitments is not transferred to a carrier simply because a carrier handles the shipment.
A8. Site, approvals and installation
Before ordering, check the proposed location and intended use with the relevant council or qualified building professional. Requirements depend on the site, design and use. A small floor area, product name or product image does not establish that a particular use is permitted or that approval is unnecessary.

Unless expressly included in your agreed scope, kit prices exclude permits, site preparation, foundations, installation, electrical connection, plumbing and landscaping. Tell us before ordering if you are relying on our advice for a particular purpose. This section does not remove our responsibility for representations we make or any applicable consumer guarantee.

Where you separately engage an independent installer, confirm their scope, price, qualifications and contract directly with them. A referral does not by itself mean installation is included in your purchase from us. We remain responsible for our own goods, statements and obligations.

Follow the storage, handling, assembly and maintenance instructions supplied for your kit. If instructions are missing or unclear, contact us before starting the affected work. Check the components before assembly and do not install a component you reasonably believe is damaged or unsafe. Any assessment of damage associated with storage, installation or alteration will consider its cause. This does not automatically cancel your warranty or consumer rights, or limit our responsibility for the accuracy of information we supply.
A9. Product concerns and warranties
Contact Avant Living if a product is faulty, damaged, incomplete or different from what was agreed. Part B below explains how to request assistance.

Any advertised express warranty is additional to your statutory rights. Its applicable terms should be available before purchase. An expired manufacturer's warranty does not automatically end your consumer rights, and you do not have to deal only with the manufacturer to seek a remedy from us.
A10. Privacy, complaints and changes to these terms
Our Privacy Policy explains our handling of personal information. It is available through the website footer.

Send complaints to the contact details above, including enough information for us to identify the order and understand the issue. If the issue remains unresolved, you may seek assistance from your state or territory consumer affairs body or pursue other available remedies.

Changes to these terms apply to future orders. They do not retrospectively change an existing order without your agreement or override applicable law.
Part B — Returns, Refunds & Cancellations
B1. Changing your mind
You may cancel for a full refund within 24 hours of payment. This voluntary cancellation period does not limit any statutory cancellation or refund right.

After this 24-hour period, you may request a change-of-mind return after dispatch and no later than 14 calendar days after signing for delivery, provided the kit has not been installed. This is the deadline to request a return, not a requirement for the kit to reach us within 14 days. A 20% restocking fee applies, calculated on the amount you paid for the affected goods, including applicable GST and after discounts, but excluding separately charged delivery. Freight costs are treated as follows: After the 24-hour full-refund period, delivery charges already incurred are not refundable for a change-of-mind return. You are also responsible for the reasonable actual cost of return transport, including equipment needed for collection. We will confirm the return arrangements and cost with you before booking. We will not charge the same transport cost twice.

For a change-of-mind return, the kit must be uninstalled, complete and free from damage caused after delivery by you or anyone acting on your behalf. Contact us within the 14-day application period so we can arrange return instructions and collection. Please retain protective packaging where practical and protect the components while collection is arranged. If the kit is still in transit, contact us so we can discuss whether interception or return transport can be arranged. Otherwise, we will agree a reasonable collection date with you. These conditions do not restrict claims for faults or damage for which we are responsible.

We do not accept change-of-mind returns after installation. These change-of-mind conditions and fees do not apply to a remedy you are entitled to for faulty goods or another failure to meet a consumer guarantee.
B2. Cancelling before dispatch
For a change-of-mind cancellation received after the first 24 hours following payment but before dispatch, a 10% administration fee applies, calculated on the amount you paid for the affected goods, including applicable GST and after discounts, but excluding separately charged delivery. The 10% pre-dispatch fee and the 20% post-dispatch fee are alternatives; they are not charged together. No administration fee applies to a cancellation received within the first 24 hours following payment or where a fee cannot lawfully be charged.

The 24-hour period means 24 consecutive hours from the first successful payment for the order; later balance payments do not restart it. Email info@avant-co.com.au or call 1300 361 800 to cancel. The time we receive your email or cancellation call determines whether you are within the period, not when we process your request. We will not dispatch the kit during this period. A full refund within this period includes all amounts paid for that order, including delivery, without an administration or payment-processing deduction. For a later pre-dispatch cancellation, delivery charges that have not been incurred will be refunded; any proposed deduction for delivery costs already incurred must be lawful, documented and disclosed before purchase.

If we cannot supply your order as agreed and you do not accept an alternative, we will refund payments for the unfulfilled order. Any further rights available by law are preserved.
B3. Faulty, damaged, incorrect or incomplete goods
Contact us if your kit arrives damaged, has missing or incorrect components, or develops a fault. We will assess the issue and provide the remedy required by law.

For a major product failure, you can choose a refund or replacement. For a minor failure, we can generally remedy the problem within a reasonable time. If we do not, you may be entitled to arrange a repair and recover reasonable costs, or reject the goods and obtain a refund or replacement, as applicable under law. Compensation may also be available for reasonably foreseeable loss.

Sale items and custom-made goods retain applicable consumer guarantees. We do not apply a fixed store-policy deadline to those rights.
B4. How to contact us
Email info@avant-co.com.au or call 1300 361 800. Give your order number or other proof of purchase and describe the issue. Photographs of the affected components and packaging can help, where reasonably available. Original packaging is not required for a consumer-guarantee claim.

Report visible delivery damage promptly so we can investigate. A delivery signature or delay in noticing a hidden fault does not automatically remove your rights. Do not use a component you reasonably believe is unsafe.
B5. Collection and return costs
Contact us to arrange safe return or assessment of a bulky kit. For faulty goods that are large, heavy or difficult to remove, we will arrange collection or pay the necessary return transport. Reasonable return costs you have already paid will be reimbursed where a product problem is confirmed.

We will provide the collection or return instructions; please do not send a kit to an office or correspondence address. Where possible, protect the goods from further damage while arrangements are made.

We do not charge a restocking fee for a remedy you are entitled to under consumer law.
B6. Refund method and timing
Refunds are made to the original payment method unless we agree otherwise with you. We will not substitute store credit for a refund you are entitled to without your agreement.

Once your entitlement to a refund and the amount payable have been established, we will initiate the refund within five business days. For this purpose, business days are Monday to Friday, excluding Victorian public holidays. Any necessary assessment will be handled within a reasonable time and will not be used to delay a remedy unreasonably. Your bank or payment provider may take additional time to credit the funds. We will confirm when the refund has been initiated.
B7. Warranties and support
An express warranty is additional to your consumer rights. Contact us directly for help with goods we sold you; you are not required to approach a manufacturer first.
Part C — Shipping & Delivery
C1. Delivery areas
We offer delivery within Australia. Enter your delivery address at checkout to see the automatically calculated delivery charge.

We deliver kits to physical addresses that can safely receive the booked freight service. Kits cannot be delivered to a PO Box.
C2. Delivery charges
The delivery charge is calculated automatically and shown at checkout before you place your order. It is separate from the kit price unless the order expressly includes delivery.

The delivery charge shown at checkout is the final charge for your order, including any forklift or crane unloading required for the agreed delivery service. We will not add a mandatory remote-area, island or unloading surcharge after you place the order.

If you later request a different address or delivery service, we will explain any revised charge and obtain your agreement before making the change. If an unforeseen issue prevents the agreed delivery, we will discuss a solution and preserve any applicable cancellation or refund rights.
C3. Availability and delivery times
Delivery times depend on the availability of your selected product and your delivery address. In-stock and backorder items have different lead times. We will disclose the stock status and estimated dispatch and delivery times for your order before purchase. The estimate shown for your selected product and destination at the time of ordering applies to your order. Please retain that estimate together with your order confirmation. The delivery estimate covers the period from placing your order to expected arrival, including preparation and transport. The initial 24-hour cancellation period is included in that estimate.

An item on backorder is not available for immediate dispatch. Please refer to the availability and timing information shown for your selected configuration when ordering.

We will notify you of a material delay and provide an updated estimate and available options. Calling a date an estimate does not remove our responsibility to supply within the agreed or otherwise legally required time, or your right to a remedy where applicable.

Avoid booking installation solely on an estimated delivery date. Confirm arrival and check the supplied components before arranging work that depends on them.
C4. Access and unloading
Where a forklift or crane is required for the agreed delivery, it will be provided and operated by the delivery provider. You do not need to arrange or operate unloading equipment. Delivery includes unloading at a safe, accessible ground-level point at the delivery address. We or the delivery provider will coordinate the exact unloading point with you. The checkout delivery charge includes the equipment required for this service; you do not need to book it separately.

Tell us before ordering about narrow driveways, low overhead clearance, steep or soft ground, parking restrictions or other access limitations. We will use that information to agree a safe delivery arrangement.

Delivery does not include transporting components through a house, over a fence or to the final building position unless expressly included in the booked service. Please do not attempt unsafe manual unloading of heavy components.

We remain responsible for delivery and unloading performed by our delivery provider, including loss or damage caused during that service. Once unloading is complete and the kit has been handed over to you or your nominated adult at the agreed safe location, please keep it secure and follow the applicable storage instructions. This does not limit our responsibility for transit damage, concealed damage, product faults or any rights you have under law.
C5. Booking, postponement and unsuccessful delivery
An adult must be present to receive and sign for the delivery. We do not permit unattended delivery or authority to leave. We or the delivery provider will contact you using your order contact details to arrange the delivery appointment. Please ensure these details are correct and that an adult can attend the agreed appointment.

If delivery cannot be completed, we will contact you to agree the next step. A customer-requested rebooking or a failed delivery caused by inaccurate access information may involve a reasonable additional charge only where its basis was disclosed before purchase and the applicable amount is agreed. You will not be charged for a failed delivery caused by us or our carrier.

If you need to postpone an agreed delivery, contact us as early as possible. We will confirm the revised arrangements and any effect on timing in writing. Any optional storage arrangement or customer-requested rebooking charge resulting from your postponement must be explained and agreed in writing before it is incurred; a request to postpone does not itself authorise an additional charge. We will not charge you for storage or delay caused by us or our delivery provider. Your statutory rights remain unaffected.
C6. Checking the delivery
Where safe and practical, check the number of packages and note visible damage when the delivery arrives. Contact us promptly about damage, missing items or an incorrect shipment. Photographs can assist the investigation, but signing for delivery does not waive your rights for concealed damage or other product problems.

Part B of these terms explains the process for assistance. We remain your contact for delivery issues involving our carrier.
C7. Contact
Email info@avant-co.com.au or call 1300 361 800, quoting your order number where available.
